1. Acceptance of terms

By accessing or using Incentv ("the Service"), operated by Incentv ("we", "us", or "our"), you agree to be bound by these terms. If you do not agree, do not use the Service.

2. Description of service

Incentv is a commission management platform that allows organizations to configure sales campaigns, upload transaction data, calculate commissions, and manage payouts. The Service is provided on a subscription basis.

3. Accounts and access

• You must provide accurate and complete information when creating an account.
• You are responsible for maintaining the security of your account credentials.
• You must be at least 18 years old to use the Service.
• One person or organization may not maintain more than one free account.

4. Your data

You retain ownership of all data you upload to Incentv. We do not claim any intellectual property rights over your content. You grant us a limited license to process your data solely to provide the Service.

5. Acceptable use

You agree not to:

• Use the Service for any unlawful purpose
• Attempt to gain unauthorized access to any part of the Service
• Interfere with or disrupt the Service or its infrastructure
• Reverse engineer, decompile, or disassemble the Service
• Use the Service to store or transmit malicious code
• Resell or redistribute the Service without our written consent

6. Payment and billing

Paid plans are billed in advance on a monthly or annual basis. All fees are non-refundable except as required by law. We may change pricing with 30 days' notice.

7. Service availability

We strive to maintain high availability but do not guarantee uninterrupted access. We may temporarily suspend the Service for maintenance, updates, or circumstances beyond our control.

8. Limitation of liability

To the maximum extent permitted by law, Incentv shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunities, arising from your use of the Service.

9. Disclaimer of warranties

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

10. Termination

Either party may terminate this agreement at any time. Upon termination, your right to use the Service ceases immediately. We may retain your data for a reasonable period to allow you to export it, after which it will be deleted.

11. Changes to these terms

We may modify these terms at any time. Material changes will be communicated via email or a notice on the Service. Continued use after changes constitutes acceptance.

12. Governing law

These terms are governed by the laws of the State of Delaware, United States, without regard to conflict of law principles.
